Digital Product License Terms
These Digital Product License Terms govern the use of digital educational resources purchased from Encouraging Math.
When you purchase or download an Encouraging Math product, you are purchasing a license to use the resource, not ownership of the resource or its intellectual property rights. Your permitted use depends on the license associated with the product at the time of purchase.
1. General License Terms
Unless expressly stated otherwise, all Encouraging Math digital products are protected by copyright and are licensed only for the uses described in these terms.
Purchasing a product does not grant permission to resell, redistribute, sublicense, publish, or otherwise make the digital file available to individuals or organizations outside the applicable license.
You may maintain a reasonable personal backup copy of a legitimately purchased file. A backup copy does not create an additional license or expand the number of people permitted to use the resource.
2. Personal / Household License
A Personal / Household License permits use of the purchased resource by one household.
Under this license, you may:
- Use the resource with children or learners who are members of your household.
- Print reasonable copies for those household members.
- Save a personal backup copy for your household’s future use.
You may not:
- Share the digital file with another household.
- Email, message, copy, or transfer the file to friends, relatives, homeschool groups, co-ops, tutors, educators, or other individuals outside your household.
- Print copies for distribution to other households or groups.
- Upload the file to a shared drive, website, social media group, online classroom, file-sharing service, or other location accessible to people outside your household.
- Resell or redistribute the resource in digital or printed form.
Each household using the resource must obtain its own appropriate license.
3. Individual Educator License
An Individual Educator License permits use by one educator with students that educator personally teaches.
Under this license, the licensed educator may:
- Use the resource with students they personally teach.
- Print copies for those students as reasonably necessary for instruction.
- Use the resource during the educator’s own classroom, tutoring, or instructional activities.
- Maintain a personal backup copy.
The license belongs to the individual educator and does not automatically extend to other teachers, tutors, staff members, departments, schools, or organizations.
The digital file may not be shared with colleagues or placed in a shared digital location accessible to other educators unless a broader license has been purchased.
4. School / Organization License
A School / Organization License permits use according to the scope stated for that license at the time of purchase.
Depending upon the product or license purchased, authorized users may include multiple educators or learners within the licensed school or organization.
A School / Organization License does not permit:
- Distribution outside the licensed organization.
- Sharing with unrelated schools, organizations, households, or educators.
- Public posting or unrestricted online access.
- Resale, sublicensing, or commercial redistribution of the resource.
If a school or organization requires use beyond the scope stated with the purchased license, an expanded license or additional licenses may be required.
5. Digital File Sharing
Regardless of license type, the original digital files may not be distributed beyond the users authorized by the applicable license.
This restriction includes sharing through email, messaging applications, cloud storage, shared drives, websites, social media, online groups, file-sharing platforms, or other electronic distribution methods.
Purchasing additional download access does not grant additional users or households permission to use the resource.
6. Modification of Resources
Resources may be printed and used as intended for educational purposes.
Unless expressly permitted with a particular product, purchasers may not modify, extract, repackage, translate, adapt, or incorporate substantial portions of an Encouraging Math resource into another product for distribution, publication, or sale.
Removing copyright notices, branding, attribution, or other identifying information from a resource does not alter these license requirements.
7. Commercial Use and Resale
Encouraging Math products may not be:
- Resold as digital files.
- Resold as printed worksheets, workbooks, packets, or other products.
- Included in another product offered for sale.
- Used as source material for a competing commercial resource.
- Distributed as part of a paid membership, subscription, resource library, or downloadable collection unless expressly authorized in writing.
Charging students for tutoring or educational instruction does not, by itself, constitute resale when the resource is being used under a valid Individual Educator or School / Organization License.
8. Copyright and Ownership
All copyrights and other intellectual property rights in Encouraging Math products remain with their respective rights holder.
Purchase of a product grants only the applicable license to use the resource. No copyright, trademark, ownership, or other intellectual property rights are transferred to the purchaser.
9. License Violations
Unauthorized copying, sharing, redistribution, resale, or other use outside the applicable license may result in termination of access to purchased resources.
Encouraging Math reserves the right to revoke download access when there is reasonable evidence that a product has been distributed or used in violation of these terms.
Termination of access does not transfer or expand any rights previously granted under the license.
10. Refunds
Digital purchases are subject to the Encouraging Math Digital Product Refund Policy.
Because digital resources cannot be physically returned after access has been provided, digital purchases are generally final, subject to the exceptions and applicable requirements described in that policy.
11. Questions About Licensing
If you are unsure whether your intended use is covered by a particular license, please contact Encouraging Math before purchasing or distributing copies.
Schools, tutoring organizations, homeschool groups, co-ops, educational programs, and other organizations requiring broader usage rights may contact us regarding the appropriate license.
